How to ask someone to be your executor

After assessing potential parties and choosing one to serve as your executor, you need to officially ask them. Understandably, doing this can be challenging, since you will be asking them to assume a critical role with legal and ethical obligations.

So, how can you handle the conversation efficiently? 

Be prepared

Before the meeting, you need to prepare documents about your estate. Your chosen party needs to understand its size and complexity. Therefore, create a detailed list of your assets and liabilities, including digital assets. 

Ask them to meet you

It can be unwise to start the conversation when you run into your chosen party, for instance, at a social gathering. You need to inform them that you want to discuss something important on a particular day and time, if they are available. When you both agree on the day and time, choose a comfortable, private location for the meeting, such as your home or their home.

Be direct but gentle

During the meeting, you should be direct but use a gentle approach throughout. Start by informing them you are drafting your estate plan and would like them to be your executor. Then, explain why you chose them. Tell them about the qualities they possess that you believe make them a great executor for your estate.

After that, clearly outline their expected responsibilities to help them understand their immediate and future duties. Additionally, provide them with your list and encourage them to ask questions.

Give them time to respond

End the conversation by informing them they don’t have to answer immediately. They can take a few days to think and learn more about the role.
